康尼先生就任联邦移民部长之后，对加国的移民系统进行了大幅度的改革，他的许多针对性的措施，几乎是刀刀见血，既让不少人叫好也引发激烈的争议。这次康尼先生公布的新的移民改革的举措，是关于父母、祖父母移民政策的改变。

加拿大的父母、祖父母移民申请是在2011年11月5日开始暂停的，根据康尼在上周五的宣布，这一“暂停”将在明年的1月2日寿终正寢，政府将在当日重新开始接受申请。然而，在康尼宣布了这一“喜讯”之后，不少一直在翘首以盼的申请者，却感到被兜头浇了一盆冷水。因为其中不少新规定，使得一些自身条件不够，寄望于玩“花样”，来申请父母移民的人，再也难以暗渡陈仓。不少华文媒体在报道这一新闻时，也用了“苛刻”这个词予以形容，相信当申请程序正式启动后，随着父母、祖父母长者移民的数量比以前的大幅度下降，这一“新政”将极有可能会被人权团体、移民顾问行业以及反对党再度猛烈抨击。

康尼部长于上周在密西沙加市公布的关于父母、祖父母移民的新规定主要有以下几方面的内容。第一：加国的担保人的最低年收入标准将提高30%。例如一对本地夫妇想要担保境外的父母来加拿大，原来的年收入只要4万2千元就足够，现在则需5万4千元。第二：在确定担保人的收入方面，今后移民部只以联邦税务局的评估单为依据，而且申请者必须提供三年的评估单，以前只是一年。第三：担保人对长者的担保期限也从之前的十年增加至二十年。第四：与被担保人同行的未成年子女的年龄，从以前的二十二岁的“大小孩”降至十八岁，而且没有任何例外豁免。第五：每年只接受5000份申请。

从移民部的这一新规定中，我们不难看出：从今以后，一对技术或投资移民夫妇，在加国定居后，又分别将另外两个家庭的四位老人以及老人家里的“大小孩”一连串“拖过来”，占用这里社会资源的情况，将会受到严格限制。

加拿大是西方世界中为数不多的对外来移民极其慷慨宽容的国家。若干年来，由于这里广受欢迎的移民政策、宽松环境和福利条件，也吸引了许多世界各地的移民前来开创新生活。随着加国社会的老龄化和婴儿潮时期出生人士的逐步退休，加国对移民的需求更是有增无减。然而在如何吸收移民？吸收什么样的移民？追求数量还是质量方面？社会上一直存在着争议。事实上，由于长期以来，历届政府在移民政策上的消极和“不作为”，在我们的周围确实出现了不少移民制度被滥用的事例，而接连不断的被担保长者移民申请社会福利的现象，更是让“移民必须对国家经济有利”的良好初衷被打了折扣。

康尼部长在公布了父母、祖父母移民政策的“新政”之后，接受了某中文电视台的专访，他说：加国吸收移民的目的，就是要让他们的才能和勤劳来带动本国经济的发展，这样对他们自己和国家都有好处。康尼毫不讳言地表示：长者移民来加国之前，没有为加国工作和纳过税，他们来了之后，能继续工作和纳税的也只有很小一部分，但是他们却占用了大量的的医疗和社会福利资源。因此为了保护加拿大的公共福利系统，减少家庭团聚移民所产生的负面影响，有必要制定措施，确保担保人的担保责任，避免将负担转嫁給社会。

康尼还表示：目前在长者移民中，过了十年担保期之后，申请低租公屋居住的比例已大幅标升，达到了25%，他对这个数字的上升很不高兴。这对在这里工作、纳税了一辈子，也在排队等侯公屋居住的老人相当不公平。其实除了康尼所披露的这些情况之外，我们都知道：在华人社区中，还有不少长者移民一方面住在政府提供的低租的老年公屋里，在领取老年金之外又拿着老年低收入保障金（OAS），但同时他们在国内还有数千、甚至上万元的退休工资和房屋出租的收入。移民部这次的新规定如此严厉，也正是出于对付这种敲加拿大竹杠的欺诈行为，保护公众利益的需要。

在父母和祖父母与家人团聚的移民事项上，来自南亚及中国地区的移民与来自欧洲、南美洲以及日本、韩国等地区的移民有着相当大的传统习惯上的不同。因此，南亚和中国移民群体中申请父母、祖父母来加国移民的比例也是各族裔中最高的。多年以来，在这一群体中，在申请长者移民时弄虚作假，几乎已成了公开的秘密，有些担保人明明没有足够的收入，也硬是要花钱造假，让自己的父母、祖父母获取移民资格。他们串通 “不良”雇主和移民顾问，每年化数千元做“假”工资单，将自己的名字用在别人的工时上报税，竭力炮制一份“符合要求”的收入证明。由于这类担保人本身的经济能力有限，所以一旦他们的父母、祖父母移民来到加国，他们就会想方设法将自己的责任转移给社会，担保期一过，就即刻让长者向政府申请公屋、申请老年福利金。在移民部的新规定中：提高了担保人收入三成，并且要以三年的税单为据。这在客观上也加重了部分人再弄虚作假“买税”的成本，估计可以让他们知难而退，还有可能令那些帮助欺诈的移民顾问再也没钱赚。

从加拿大的国家利益出发来制定移民政策，这是康尼一贯坚持并且从不隐瞒的想法。然而在重视父母亲情、注重家庭团聚的移民群体之中，许多人对此还是不理解，他们想当然地认为：移民加拿大，自然也包括了让长者与子女团聚这些内容。对此，康尼在中文电视专访中再次强调：如果技术移民的主要目的就是家庭团聚的话，那么他们根本就不应该离开自己的国家。他们决定离开父母，就是为了在这里寻求机遇。康尼认为：加拿大吸引优秀移民的关键，不是靠什么与父母、祖父母团聚的移民政策，而应该是本国良好的经济发展、高薪的工作职位、稳定的国家财务状况、强健的银行和金融系统，以及民主自由的社会制度、普世价值观等等。因此，移民的质量比数量对国家更重要。对长者移民采取严格的标准，要求担保人确保自己的担保责任，是得到大多数国民支持的举措。

48岁的马林，是广西医科大学第一附属医院“副教授”，开始在化疗科工作，后来被调到医院办公室。

同月25日18时许，马林又在该房内帮彭花按摩治疗。彭花表示，她在治疗后起身上厕所，发现阴部除有黄色药膏外，还有乳白偏黄像精液的液体，便质问马是否对其性侵，遭否认。18时30分许，她离开诊所，当晚与男友通话后，向警方报案。二审判决称，马林让彭花躺到其自制的治疗床上后，以给彭花的阴部按摩治疗为由，欺骗彭花并强行将其精液放进彭花的阴道内，强行对彭花实施猥亵。次日11时许，马林被公安人员抓获。经DNA检验，彭花的阴道分泌物中被检出其精斑。

然而，2011年3月18日，南宁市青秀区检察院决定批捕马林，涉嫌的罪名是强制猥亵妇女罪。该院随后以马林犯强制猥亵妇女罪，向法院提起公诉。该罪名未被一审法院采纳。去年7月，青秀区法院一审以强奸罪，判处马林有期徒刑4年。当时法院认为，马林违背妇女意志，使用欺骗手段强行与妇女发生性交，构成强奸罪。

昨日，南宁市中院作出终审判决，认为马林无医师执业资格无证行医，对外谎称是“广西医科大一附院副教授、医生”，利用被害人到其心理咨询室就诊治疗的机会，违背妇女意志，采取欺骗手段强行对彭花进行猥亵，构成强制猥亵妇女罪。

南宁市中院昨日终审判决：撤销原审强奸罪的判决，改判马林犯强制猥亵妇女罪，判处有期徒刑3年。

不属强奸

在马林心理咨询室里，有张保健床，床尾有两个支架，患者躺在床上，两腿搁在架子上，彭花表示马林在此实施了犯罪。治疗床能否实施性行为，成为法庭的争议点之一。

法院表示，事发后，经现场查看该治疗床，发现涉案治疗床已被他人改变了原始现场状态，不能证实是马林对彭花实施按摩治疗时的原始状态，马林供述也承认曾在次日进行了清理。根据现有证据，仍没有充足依据证实马林有对彭花实施了奸淫行为。因此，对于马林及其律师提出的其仅对平躺在治疗床上的被害人进行按摩治疗，没有对躺在治疗床上的被害人实施性侵的辩解及辩护意见，法院予以采信。

对于马林提出的自创药方及人体精液可以治病的辩解，法院称，根据广西壮族自治区药监局出具的复函，已证实人体精液不属药用物质，不能作为药品使用。马林提供的广西中医学院中医副教授蒋某自书的《关于人体精液的药用作用》，仅证实是蒋某的个人观点，没有经过科学论证，不能作为证据。

法院在判决中还引用了《本草纲目》的记载，反映人精对妇科疾病的治疗没有任何疗效。法院认为，马林在对患者治疗时既不告知并未经女患者同意，将自己未经检验的精液强行放置到女患者的阴道里，既违背道义和法理，也没有充足的医学依据。
